Patriarchy means that the government behaves towards its citizens, like a father behaves towards a child. The use of the word patriarchy became more popular in the 19th century and with the emergence of modern governments, it was included in the ranks of legal terms. Patriarchy is mostly justified by the premise that sometimes people have this weakness that they cannot act in their best interests and the government, representing the society, takes the place of the father to prevent the damage of those people. Today, the application of this principle can be seen in the criminal law of any country, including Afghanistan. The purpose of this research is to examine the theories of the supporters and opponents of patriarchy and to show the examples of this principle in which crimes are reflected in the criminal law of Afghanistan. Recently, the role of criminal politics and patriarchal thought has also been discussed. The research method in this article is analytical-descriptive and using library sources. The findings of this research show that the principle of patriarchy has been found in crimes related to drugs, panhandling, illegal profit, pornography in cyber space, gambling, etc. Most of the supporters are of the opinion that individual freedom is not the final reference on the basis of which one can test the profit and loss of the individual, but what is important is that the individual's good will, even if it limits personal freedom, can have the last word in this matter.
