Abstract

The definition of personal factors of the fall of punishment are factors that have a personal aspect and are related to the personality of the perpetrator or victim against or accused and have nothing to do with the actions of the perpetrator or the history of judicial proceedings. The purpose of this article is to investigate which cases are considered as personal factors in the criminal law of Afghanistan to be investigated. The research method, according to the nature of the research, this research is theoretical, according to the subject of the research, it is legal, according to the nature of the descriptive-analytical research, and in terms of the method of collecting information and data, it is a library and uses library resources. has beenThe sources used in this article are Persian books, and a number of articles and theses have also been used, and the criminal laws of Afghanistan have been used extensively. The most important achievements of this article are that the personal factors of punishment in Afghanistan's criminal law include the death of the accused or the convicted, private amnesty, forgiveness of the plaintiff in forgivable crimes.
