A review of applied jurisprudence in Afghan and British law

Abstract

In today's era, crime detection is one of the most complicated stages of proceedings, because along with the progress of science and technology, crimes have also developed and become more complex, which cannot be detected by traditional methods. Prosecution and official incitement and encouragement to commit a crime are among the new methods of crime detection and criminal investigation that have been created to solve this problem, but an important point is the discussion of its legitimacy or illegitimacy, which has caused confusion in the criminal systems of the world: Some are in favor of the use of such a method and some emphasize the prohibition of its use in the detection of crimes.

Although there are some similarities between the law of England and Afghanistan, there are also significant differences: in the law of England, law of the land is not officially accepted as a defense in favor of the accused, it is only considered as a reduction of the punishment, but in Afghan law, there is a clear discussion on this matter. It has not been done, only the "covert discovery" measures have been mentioned, but from some general articles and the principles governing it (such as violation of the principle of innocence, etc.), the relative illegitimacy of animal husbandry can be inferred.
